Sometimes when people are experiencing problems in their relationship, they choose divorce because they are unable to see a path to reconciliation. Mediation to Stay Married (Marital Mediation) is a method of helping couples who are experiencing marital problems and who would prefer to stay together rather than get divorced. It uses dispute resolution techniques to help the couple get through issues that they are facing and empower them with tools and an understanding that will help them to strengthen their marriage. The mediator will help the couple create concrete solutions.
Mediation to Stay Married is not marriage counselling or therapy. There is no diagnosis, therapy, or deep delve into the past or psychological issues. Mediation is dispute resolution. The focus is on resolving the particular issues or disputes or misunderstandings and making plans to address issues in the future.
The mediation process fosters positive, respectful relationships, and by tackling the issue(s) that the couple has been struggling with, the process can be extremely helpful within a marriage.
Having a mediator with a legal background is of particular benefit when you need to discuss financial and legal issues, and when you need information about family law, interests of blended families, divorce, and estate planning.
Where desired, decisions that are made in mediation can be confirmed in writing as a legally binding Postnuptial Interspousal Agreement, or a Memorandum of Understanding.
